These Terms of Use ("Terms") govern your access to and use of the Byuti Point platform, including the website byutipoint.com and any related mobile or web applications (collectively, the "Platform"), operated by Phoenix Global LLC, a Wyoming limited liability company ("Company," "we," "our," or "us").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. About Byuti Point

Byuti Point is an online beauty marketplace that connects consumers with independent beauty professionals, salons, spas, and wellness studios ("Service Providers"). We facilitate discovery, appointment booking, and loyalty rewards through our Platform. Byuti Point does not employ Service Providers and is not responsible for the services they deliver.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By using the Platform, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@byutipoint.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Booking & Appointments

The Platform allows you to book appointments directly with Service Providers. By making a booking, you agree to the Service Provider's individual cancellation and refund policies. Byuti Point is not a party to the service agreement between you and the Service Provider and is not liable for cancellations, no-shows, or service disputes.

If you have a dispute with a Service Provider, please contact them directly. We may, at our discretion, assist in facilitating a resolution.

5. LEVL Loyalty Program

The LEVL Loyalty Program allows consumers to earn and redeem loyalty points at participating Service Providers. Points have no cash value and may not be transferred or sold. Phoenix Global LLC reserves the right to modify, suspend, or discontinue the loyalty program at any time with reasonable notice. Accumulated points may expire if an account is inactive for 12 consecutive months.

6. Service Provider Listings

Service Providers listed on the Platform are independent businesses. Byuti Point does not guarantee the quality, safety, or accuracy of their services or listings. Consumer reviews displayed on the Platform are the opinions of individual users and do not constitute endorsements by Byuti Point.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Post false, misleading, or defamatory reviews or content
  • Attempt to access another user's account without authorization
  • Scrape, copy, or redistribute Platform content without written permission
  • Interfere with the technical operation of the Platform
  • Use the Platform to send spam or unsolicited communications

8. Intellectual Property

All content, trademarks, logos, and software on the Platform are the property of Phoenix Global LLC or its licensors. You may not reproduce, distribute, or create derivative works from Platform content without our express written permission.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PHOENIX GLOBAL LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Phoenix Global LLC and its members, managers, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration in Cheyenne, Wyoming, under the rules of the American Arbitration Association. You waive any right to a jury trial or class action proceeding.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
